Claims against parties insured with Setanta

The High Court has found that the Motor Insurers’ Bureau of Ireland (MIBI) is liable for claims against the policyholders of the insolvent insurance company Setanta, at the time of its entering into liquidation in April 2014. The MIBI is now potential liability to pay compensation and legal costs to some 1,750 claimants. Mr Justice Hedigan said it was clear that the background to the MIBI Agreements was the obligation to protect the innocent victims of uninsured drivers and found that the wording of MIBI Agreement 2009 means that “the MIBI have a liability to pay out in respect of claims against persons who were insured by an insurer that has become insolvent”. This is a very welcome development for claimants against parties insured with Setanta as they can now progress with their claims and for those who have obtained Orders against the insured of Setanta who can now seek enforcement of their Orders and recovery of costs.
